Question for Department of Agrarian Reform (DAR) - Provincial Office (Ilocos Norte)

Am I obliged to pay disturbance fee to a tenant farmer who does not give yearly rental for more than ten years in the past,paid 2 year rental but failed again for 3 consecutive years up to present? Thank you for your help.
